ACCEPTANCE OF TERMS

By accessing, using, or engaging with the services provided by Home Stimulus ("we," "us," "our," or "Company"), you ("you," "your," or "User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Home Stimulus.

If you do not agree to these Terms, you must immediately discontinue use of our services and refrain from accessing our website, materials, or communications.

By engaging our services, including but not limited to requesting information, scheduling consultations, or receiving guidance, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

SERVICE DESCRIPTION

Home Stimulus provides tools and guidance designed to reduce costs and increase value in real estate transactions. Our services include, but are not limited to:

Transaction Cost Analysis: We provide analysis and guidance regarding costs associated with real estate transactions, including identification of potential cost-saving opportunities and examination of transaction-related expenses.

Value Optimization Guidance: We offer guidance aimed at helping clients maximize value in their real estate transactions through strategic recommendations, market insights, and best practice advisement.

Buyer & Seller Education: We provide educational resources, consultations, and information to buyers and sellers to help them make informed decisions throughout the real estate transaction process.

Our services are advisory and educational in nature. Home Stimulus does not act as a real estate broker, agent, attorney, financial advisor, or licensed professional unless explicitly stated otherwise. We do not facilitate, negotiate, or execute real estate transactions on behalf of clients.

The specific scope of services provided to you will be determined by the service package or consultation you select. Services may be delivered through in-person consultations, virtual meetings, written reports, electronic communications, or other formats as agreed upon.

USER OBLIGATIONS

As a user of Home Stimulus services, you agree to:

Provide accurate, complete, and truthful information regarding your real estate situation, financial circumstances, goals, and any other information relevant to the services being provided.

Respond promptly to requests for information, documentation, or clarification necessary for us to provide effective guidance.

Use our services and any materials provided solely for lawful purposes and in accordance with these Terms.

Maintain the confidentiality of any login credentials, account information, or access to restricted materials provided to you.

Refrain from reproducing, distributing, modifying, creating derivative works from, publicly displaying, or otherwise exploiting our proprietary materials without express written permission.

Acknowledge that you are solely responsible for decisions made regarding real estate transactions and that our services are advisory in nature.

Consult with appropriate licensed professionals, including real estate agents, attorneys, accountants, and financial advisors, before making significant real estate decisions.

Refrain from using our services to engage in fraudulent, deceptive, or illegal activities.

Notify us immediately if you become aware of any unauthorized use of our services or materials.

APPOINTMENT SCHEDULING AND CANCELLATIONS

Scheduling: Appointments for consultations and services may be scheduled through our designated scheduling system, by email, or through other methods we make available. Appointments are subject to availability and confirmation by Home Stimulus.

Confirmation: All scheduled appointments must be confirmed by Home Stimulus. We reserve the right to decline or reschedule appointments at our discretion.

Cancellations by User: If you need to cancel or reschedule an appointment, you must provide notice to us at least 24 hours in advance of the scheduled appointment time. Cancellations made with less than 24 hours notice may result in forfeiture of any fees paid or assessment of a cancellation fee, as applicable to your service agreement.

No-Show Policy: Failure to appear for a scheduled appointment without prior notice constitutes a no-show and may result in forfeiture of fees paid and potential suspension of services.

Cancellations by Home Stimulus: We reserve the right to cancel or reschedule appointments due to emergencies, illness, unforeseen circumstances, or other reasonable causes. In such cases, we will make reasonable efforts to notify you promptly and reschedule at a mutually convenient time. If rescheduling is not possible, any prepaid fees for the cancelled session will be refunded or credited.

Late Arrival: If you arrive late to a scheduled appointment, the session may be shortened to accommodate scheduled commitments, and you will be charged for the full scheduled appointment time.

PAYMENT TERMS

Fees: Fees for services are as quoted at the time of engagement and may vary based on the scope and nature of services requested. All fees will be communicated to you before services are rendered, unless otherwise agreed.

Payment Methods: We accept payment methods as indicated at the time of service engagement. Payment information must be accurate and current.

Payment Timing: Unless otherwise specified, payment is due prior to the delivery of services. For ongoing or multi-session engagements, payment terms will be specified in your service agreement.

Refund Policy: Fees paid for completed services are generally non-refundable. Refunds for cancelled services will be handled in accordance with the cancellation policy outlined in these Terms. Any requests for refunds must be submitted in writing to Jori.Bowie@homestimulus.net.

Late Payment: Failure to pay fees when due may result in suspension or termination of services. Accounts more than 30 days overdue may be subject to late fees and collection efforts, and you agree to pay all costs of collection, including reasonable attorney fees.

Disputed Charges: If you dispute any charge, you must notify us in writing within 30 days of the charge. Failure to dispute a charge within this timeframe constitutes acceptance of the charge.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Home Stimulus and its owners, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of our services, including but not limited to:

Financial losses resulting from real estate transactions or decisions made based on our guidance or analysis.

Lost profits, lost opportunities, or diminution in property value.

Errors, omissions, or inaccuracies in information provided.

Delays, interruptions, or unavailability of services.

Unauthorized access to or alteration of your transmissions or data.

Actions or omissions of third parties, including real estate agents, brokers, lenders, inspectors, contractors, or other professionals.

Your reliance on information or guidance provided by Home Stimulus.

In no event shall Home Stimulus's total liability to you for all claims arising from or related to our services exceed the total amount of fees you paid to Home Stimulus in the six months preceding the claim.

You acknowledge that real estate transactions involve inherent risks and that numerous factors beyond our control affect transaction outcomes. Home Stimulus does not guarantee any particular result, cost savings, value increase, or transaction success.

WARRANTY DISCLAIMERS

Home Stimulus provides services and materials on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

Warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

Warranties regarding the accuracy, reliability, completeness, or timeliness of any information, guidance, analysis, or materials provided.

Warranties that our services will meet your requirements, achieve your goals, or produce specific results.

Warranties that our services will be uninterrupted, secure, or error-free.

We do not warrant that information provided is comprehensive, current, or applicable to your specific situation. Real estate markets, laws, regulations, and practices vary by location and change over time. You are responsible for verifying information and determining its applicability to your circumstances.

Home Stimulus is not a substitute for professional services provided by licensed real estate agents, attorneys, accountants, financial planners, inspectors, or other specialists. We strongly recommend consulting with appropriate licensed professionals before making real estate decisions.

We make no representations or warranties regarding third-party services, websites, products, or professionals that may be mentioned or referenced in connection with our services.

GOVERNING LAW

These Terms and any disputes arising from or related to our services shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms or our services must be brought exclusively in courts of competent jurisdiction, and you consent to the personal jurisdiction and venue of such courts.

You agree to waive any objection to jurisdiction or venue in such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

INTELLECTUAL PROPERTY

All content, materials, tools, analysis, reports, methodologies, and other intellectual property provided by Home Stimulus remain our exclusive property. This includes but is not limited to text, graphics, logos, images, software, data compilations, and proprietary processes.

You are granted a limited, non-exclusive, non-transferable license to use materials provided to you solely for your personal real estate decision-making purposes. You may not reproduce, distribute, modify, display, perform, or create derivative works from our materials without express written permission.

Trademarks, service marks, and logos displayed are the property of Home Stimulus or their respective owners. Nothing in these Terms grants you any right to use such marks.

CONFIDENTIALITY AND PRIVACY

We respect your privacy and handle personal information in accordance with applicable privacy laws. Information you provide in connection with our services will be used to deliver services, communicate with you, and improve our offerings.

We maintain reasonable security measures to protect information, but cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any account credentials.

We may use aggregated, anonymized data derived from our services for research, analysis, and business purposes without identifying individual clients.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Home Stimulus and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorney fees, arising from or related to:

Your use of our services or materials.

Your violation of these Terms.

Your violation of any rights of third parties.

Any real estate transaction decisions or actions you undertake.

Any inaccurate or incomplete information you provide to us.

TERMINATION

Either party may terminate the service relationship at any time with written notice. Upon termination:

You remain obligated to pay for services already rendered.

Your license to use our materials immediately terminates.

Provisions of these Terms that by their nature should survive termination shall remain in effect, including limitation of liability, warranty disclaimers, indemnification, and governing law provisions.

We reserve the right to immediately suspend or terminate services if you violate these Terms or engage in conduct we deem inappropriate or harmful.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Home Stimulus regarding our services and supersede all prior or contemporaneous communications, agreements, or understandings, whether oral or written.

Any modifications, amendments, or additional terms related to specific services must be in writing and signed by authorized representatives of Home Stimulus to be enforceable.

No waiver of any provision of these Terms shall constitute a waiver of any other provision or any subsequent waiver of the same provision.

SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

FORCE MAJEURE

Home Stimulus shall not be liable for any failure or delay in performing obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, pandemic, epidemic, or failure of third-party services or infrastructure.

ASSIGNMENT

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Home Stimulus may assign these Terms or any rights or obligations hereunder without your consent.

When we make changes to these Terms, we will make the updated Terms available through our website, service communications, or other appropriate means. We may also notify you directly via email or other contact methods we have on file.

Your continued use of our services after changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of our services.
